ABOUT THESE TERMS
Fast Ebikes runs this website. Wherever “we”, “us” or “our” appears on the site, it means Fast Ebikes. We make this website available to you, the user, together with all the information, tools and Services on it, on one condition: that you accept every term, condition, policy and notice set out here.

When you visit our site, buy something from us, or do both, you are using our “Service”. In doing so, you agree to be bound by the terms and conditions below (the “Terms of Service” or “Terms”). That includes the extra terms, conditions and policies that these Terms refer to or that are available by hyperlink. These Terms of Service apply to every user of the site. Without limitation, that covers people who browse, vendors, customers, merchants and people who contribute content, or any mix of these.

Read these Terms of Service carefully before you access or use our website. If you access or use any part of the site, you agree to be bound by them. If you do not agree with every term and condition of this agreement, you may not access the website, and you may not use any Services. Where these Terms of Service are seen as an offer, we expressly limit acceptance of that offer to these Terms of Service.

The Terms of Service also cover any new feature or tool added to the current store. The latest version of the Terms of Service is on this page, and you can read it at any time. We may post updates or changes, or both, on our website to change, replace or update any part of these Terms of Service. You are responsible for checking this page from time to time for changes. If you keep using or accessing the website after we post a change, you accept that change. A change to these Terms does not apply to an order you have already placed. That order stays governed by the Terms and policies that were in effect on its order date.

Shopify Inc. hosts our store. Shopify supplies the online e-commerce platform through which we sell you our products and Services.

---

SECTION 1 - USING OUR ONLINE STORE
When you agree to these Terms of Service, you represent that you have reached at least the age of majority in the province where you live, or that you have obtained consent for this site to be used by minor dependents. You may not use our products for any purpose that is illegal or unauthorized. While using the Service, you also may not violate any law in your jurisdiction, including, without limitation, copyright law. You must not send any worm, virus or other code that is destructive in nature. If you breach or violate any of the Terms, your Services will be terminated immediately.

SECTION 2 - GENERAL RULES
We may refuse Service to anyone, at any time, for any reason. You understand that your content, other than credit card information, may be sent without encryption. Sending it may involve (a) transmission across different networks; and (b) changes made so that it conforms and adapts to the technical requirements of the networks or devices it connects to. Credit card information is encrypted every time it is transferred. Unless we give express written permission, you agree that you will not copy, duplicate, reproduce, sell, resell or exploit any part of the Service. The headings in this agreement are there only for convenience; they will not limit or otherwise affect these Terms.

SECTION 3 - HOW ACCURATE, COMPLETE AND CURRENT OUR INFORMATION IS
We are not responsible if the information on this site is inaccurate, incomplete or out of date. Material on this site is for general information only. You should not rely on it, or use it as the only basis for a decision, without consulting sources that are primary, more accurate, more complete or more timely. If you rely on any material on this site, you do so at your own risk. This site may include historical information, which is given for reference only. We may change content at any time, but we have no obligation to update it. If your order is affected by a material error in a price or a description, we will tell you, and you may cancel for a full refund.

SECTION 4 - CHANGES TO THE SERVICE AND TO PRICES
Our product prices may change without notice. A price change does not affect an order that has already been confirmed. At any time, and without notice, we may modify or discontinue the Service. If we modify, suspend or discontinue the Service, or change a price, we will not be liable for it.

SECTION 5 - PRODUCTS AND SERVICES
Some products or Services may be available only online. Their quantities may be limited, and they can be returned or exchanged only as our Refund Policy allows. We make every effort to show colours and images accurately. We cannot guarantee how accurately your monitor displays them. We may, at any time, discontinue products or limit sales by person, region or jurisdiction. Where an offer is prohibited, it is void. Apart from the warranties that the law and our Warranty Policy give you, we do not warrant that any product will meet your subjective expectations.

USE, LOCAL LAWS AND ASSUMPTION OF RISK
1. Local Laws. Ontario, Quebec, British Columbia and Alberta limit power-assisted bicycles to 500 W and 32 km/h, and some of our e-bikes go beyond those limits. Buyer is responsible for using the Product in line with the laws where they ride, and does so at their own risk. See E-bike laws in Canada.

2. Assumption of Risk. Buyer expressly assumes every risk connected with operating the Product, including, without limitation, equipment failure, property damage and personal injury. Buyer confirms that they are physically able to operate the Product safely, and that they will always wear suitable protective gear.

SECTION 6 - ORDERS, BILLING AND ACCOUNT DETAILS
We may refuse any order. We may limit or cancel the quantities bought per person, per household or per order. If we make a change or a cancellation, we may try to notify you using the contact information provided. You agree to give us purchase and account information that is current, complete and accurate, and to promptly update it.

SECTION 7 - OPTIONAL TOOLS FROM THIRD PARTIES
We may give you access to third‑party tools that we do not control. We provide that access “as is”, with no warranties. If you use third‑party tools, you do so at your own risk.

SECTION 8 - LINKS TO OTHER SITES
Some content, products and Services may include material from third parties. Third‑party sites we link to are not affiliated with us, and we are not responsible for the content or practices of those sites.

WAIVER, RELEASE AND INDEMNIFICATION

1. Waiver and Release. To the fullest extent that applicable law permits, Buyer, on their own behalf and on behalf of their heirs, releases Fast Ebikes and its officers, employees and agents from every claim, liability, damage or cause of action that arises from use or misuse of the Product, and holds them harmless from the same.

2. Indemnification. Buyer will defend, indemnify and hold Fast Ebikes harmless against every third‑party claim, cost, loss or damage that arises out of Buyer’s use of the Product.

3. Consumer Rights. These Terms do not limit any right you have under the Sale of Goods Act (Ontario), the Consumer Protection Act, 2002 or the equivalent legislation of your province.

SECTION 9 - YOUR COMMENTS, FEEDBACK AND OTHER SUBMISSIONS
If you send us submissions (comments, ideas or feedback), you grant us the right to use them. We have no obligation to pay any compensation for them or to keep them confidential.

SECTION 10 - YOUR PERSONAL INFORMATION
Our Privacy Policy governs any personal information you submit.

SECTION 11 - MISTAKES, INACCURACIES AND OMISSIONS
We may correct any error or omission, and change or update information, at any time and without notice in advance.

SECTION 12 - USES THAT ARE NOT ALLOWED
You may not use the site for any unlawful purpose, to violate anyone’s rights, to upload malicious code, to send spam, or for any other purpose that could harm the Service or anyone else.

SECTION 13 - WARRANTY DISCLAIMER AND LIMITATION OF LIABILITY
We do not guarantee that the Service will work without interruption or error when you use it. We provide the Service and every product "as is" and "as available", with no warranty of any kind other than any warranty that applicable law does not allow us to exclude. In no event will Fast Ebikes be liable for any punitive, special, consequential, indirect or incidental damages. Any right you have under the Sale of Goods Act (Ontario), the Consumer Protection Act, 2002 or the equivalent legislation of your province is not limited by anything in these Terms.

Liability Cap. To the maximum extent the law permits, Fast Ebikes’ total liability for any claim related to these e‑bikes will not exceed the purchase price Buyer paid.

SECTION 14 - YOUR INDEMNITY
If a claim arises out of your breach of these Terms, or out of your violation of any law or of any third‑party rights, you agree to indemnify Fast Ebikes and its employees, directors, officers and affiliates, to defend them, and to hold them harmless from that claim.

SECTION 15 - IF A PROVISION IS INVALID
Should a provision be found unlawful or unenforceable, it will be severed, and all remaining provisions will continue in full force.

SECTION 16 - ENDING ACCESS
We may, for any reason, immediately suspend or terminate access to our Service. After termination, every section that by its nature should survive will survive.

SECTION 17 - ENTIRE AGREEMENT
These Terms, together with any policies we post, form the entire agreement between you and Fast Ebikes. They supersede all prior agreements.

REQUIRED ACKNOWLEDGEMENTS
When Buyer places an order, Buyer certifies that:
1. They have read all of these Terms and understand them, including the provisions on Use, Local Laws and Assumption of Risk; Waiver, Release and Indemnification; and Limitation of Liability.
2. They are 18 years of age or older.
3. They agree that they will operate the Product at their own risk and in line with the laws where they ride.

SECTION 18 - GOVERNING LAW
The laws of Ontario, Canada govern these Terms and any separate agreements, and those laws will be used to construe them.

SECTION 19 - UPDATES TO THESE TERMS
We may update these Terms at any time. The most current version is on this page for you to review. If you continue to use the Service, you accept the changes. An update does not apply to an order you placed before it. That order is governed by the Terms and policies that were in effect on its order date.
